Notification of mergers, takeovers and joint ventures

If your business is active on the Dutch market, it is subject to the provisions of the Dutch Competition Act (Mededingingswet). Large companies that intend to join forces by means of a merger or takeover or in the form of a joint venture (concentration) must notify the Netherlands Competition Authority (Nederlandse Mededingingsautoriteit, NMa) accordingly in advance if the merger, takeover or joint venture results in a large concentration. The NMa will decide within four weeks whether the concentration may proceed or whether a permit is required.
