Leasing shop and catering space
Lessees of small and medium-sized commercial properties are entitled to security of tenure and rent protection. If you rent a shop or catering space, you are in principle entitled to use this space for ten years. This period is subdivided into two five-year periods. You may agree to a shorter period.
At the end of the first five-year period, you can agree to a new rent with the landlord. The landlord may not implement interim rent increases unless this is laid down contractually (e.g. change in rent on the basis of the consumer price index published by Statistics Netherlands (Centraal Bureau voor de Statistiek)). Rent levels are not subject to a statutory maximum.
In the event of disputes, you can appeal to the commercial rental commission (bedrijfshuurcommissie) via the Subdistrict Court.
Please note
The security of tenure and rent protection does not apply to ordinary commercial space. The annual rent increase for residential accommodation does not apply to commercial space.
