Guarantee

If you sell a product in the Netherlands, the consumer is legally entitled to a good product, according to Book 7 of the Dutch Civil Code. This is sometimes referred to as the statutory guarantee.

Guarantee duration

There is no fixed legal guarantee period. The duration of the guarantee will depend on the service life of the product.

Burden of proof

If the product is defective, the purchaser is entitled to have it repaired or replaced. If the product becomes defective within 6 months of the purchase, you must demonstrate that the defect is the purchaser's fault. After 6 months, the purchaser must demonstrate that the defect is not his or her fault.

Business-to-business (B2B)

These rules have been specially created to protect consumers and different rules may apply to entrepreneurs who purchase a product from another entrepreneur.
