Environmental regulations

Companies in the Netherlands have to comply with environmental regulations. These are based on the Environmental Management Act (Wet Milieubeheer, Wm) and are outlined in such general environmental regulations as the General Rules for Establishments (Environmental Management) Decree (Besluit algemene regels voor inrichtingen milieubeheer) or in an environmental permit (All-in-one Permit for Physical Aspects, omgevingsvergunning).

Statutory regulations apply to, for instance:

  • Noise and vibrations
  • Energy
  • Waste materials
  • Odour
  • Air emissions
  • Discharging liquids
  • Transport management
  • Soil protection
  • Hazardous substances

The European Integrated Pollution Prevention and Control (IPPC) Directive is based on the Environmental Management Act (Wet Milieubeheer) and the Water Act (Waterwet).

Provincial Environmental Bye-laws

The Provincial Environmental Bye-law (Provinciale Milieuverordening, PMV) is based on the Environmental Management Act (Wet Milieubeheer) and the Soil Protection Act (Wet bodembescherming). Each province determines its own bye-law according to a model. The provincial authorities can include supplementary rules for specific environmental problems in the PMV. All PMVs outline the waste materials policy and indicate areas which are environmentally protected against noise and areas where the groundwater is protected.

Guide to environmental legislation and regulations

The (Dutch-language) InfoMil Guide to environmental legislation (Wetswegwijzer) presents information on the relevant environmental laws and regulations in the form of a ‘question and answer game’. Depending on your company's circumstances, it offers information on the legislation contained in the Environmental Management Act (Wet milieubeheer). The InfoMil guide to environmental legislation includes information about:

  • Electricity generation from biomass or waste
  • Emission of volatile organic compounds (VOCs)
  • Energy conservation
  • External safety
  • Agriculture (Agriculture Decree (Besluit landbouw), Greenhouse Horticulture Decree (Besluit glastuinbouw), Outdoor Manure Storage Decree (Besluit mestbassins), and Emission of unpleasant odours, dust and ammonia)
  • Transport management
  • Water conservation

Activities Decree for silkscreen printers

The Activities Decree (Activiteitenbesluit) applies to most silkscreen printers. The requirements in the Handbook of Environmental Regulations for the Graphic Industry and Packaging Printers (Handboek milieumaatregelen grafische industrie en verpakkingsdrukkerijen) serve as input for the regulations in the Activities Decree. The (Dutch-language) InfoMil information sheet ‘Activities Decree: Silkscreen Printers’ (Activiteitenbesluit: Zeefdrukkerijen) provides information to silkscreen printers on regulations related to:

  • Noise and vibrations
  • Emission of volatile organic compounds (VOCs)
  • Discharging liquids
  • Odour nuisance
  • Soil

Silkscreen printers must report their activities to the local council. Only silkscreen printers with VOC emissions exceeding 10 tons require a permit from the local council.

Activities Decree for the hotel and catering sector

The (Dutch-language) InfoMil information sheet ‘Activities Decree: Hotel and Catering Sector’ (Activiteitenbesluit: Horeca) provides information to hotel and catering businesses on regulations governing:

  • Noise
  • Oil discharges
  • Odour
  • Carbon dioxide storage
  • Waste materials

Activities Decree for the automotive sector

The (Dutch-language) InfoMil information sheet ‘Activities Decree: Automotive Sector’ (Activiteitenbesluit: Automotive) provides information to businesses in the automotive sector on regulations governing:

  • Soil protection
  • Delivery of fuels
  • Storage of fuel and hazardous substances
  • Maintenance, repair and washing of motor vehicles
  • Paint spraying work and anti-corrosion treatment
