Advertising

If you advertise in the Netherlands, you must observe the rules on misleading and comparative advertising in Book 6 of the Dutch Civil Code, which state, for example, that advertising may not be misleading. Advertising is misleading if you make claims which are incorrect or incomplete. Advertising is comparative if your advertisement refers to the name of the competitor's product or service. Comparative advertising is permitted, but may not be misleading.

Dutch Advertising Code

The Dutch Advertising Code Authority (Stichting Reclame Code) has drawn up the Dutch Advertising Code (NRC). The NRC lays down rules to be met by advertising. If a consumer believes that he/she has been misled by your advertising, he/she can submit a complaint to the Advertising Code Committee (Reclame Code Commissie). If the consumer is declared to be right, you will no longer be allowed to use the advertising in question. In some cases you will have to publish a rectification.
